Overview
The Faculty of Law is strongly engaged in society and has an international orientation, which is reflected in its research and education activities. The Faculty offers three Bachelor's programmes and a number of Master's programmes, two of which are taught exclusively in English (i.e. International and European Law and European Private Law). With its 3,500 students and 375 staff members, it is one of the largest law faculties in the Netherlands. The Faculty is located in the centre of Amsterdam.
DESCRIPTION:
The postdoctoral researcher and the PhD candidates will carry out research in the framework of the project Accountability of Executive Power in Europe, a research project funded by the Dutch Science Organization, as part of the Spinoza Prize awarded to Professor Curtin and complemented by funding from the University of Amsterdam. This research is also located within the broader research programme of the Amsterdam Centre for European Law and Governance (ACELG), Composite Constitutions in Europe:

The basic premise underlying this research project is that since EU legislative, executive, and regulatory power is expanding, formally and informally, step by step, in a growing number of domains, questions about how it should, could and is being accounted for are increasingly salient. Paradoxically both the political and administrative actors taking decisions both at the national level and at the European level are often the same (i.e., members of the national executive power, both political and administrative). This leads to distinct accountability problems because the participation of multiple actors in different contexts of rule making gives rise to the dispersion of influence and responsibility.
Various detailed empirical studies will contribute to a more nuanced understanding of the different types of executive power being exercised by various actors, according to different modes of decision-making (supranational, inter-governmental and infra-national or transnational). The aim is to contribute to a process of bringing the EU Executive out "of the shadow" by mapping the form and evolution of various executive actors as well as analyzing the manner in which this institutional and legal map fits within a constitutional perspective on the
rule of law and (democratic) accountability. At the same time, this project seeks to shed further light on the manner in which separation of powers and checks and balances might be better reflected to countervail an expanding modern executive branch, both at the European level and at the national level.
The research team will, in line with other research work within ACELG, complement a conceptual and theoretical foundation for accountability with an empirical approach. It will explore on the basis of a range of case-studies in different areas what arrangements have been made for dealing with accountability and what lessons can be learned from these experiences.
The postdoc will carry out independent research into the substantive and procedural aspects of accountability and/or open government in the context of the executive power in Europe.
The PhD candidates will carry out research on discrete questions of accountability. One project will be on participatory governance in European agencies aiming to study the phenomenon from both an empirical and normative perspective. The aim is to assess what are the effects of such participatory procedures and practices and their potential constitutional relevance. Additional information on this research project is available upon request. The second project while being situated within the framework of Accountability of Executive Power in Europe it allows applicants to propose their own research plans. For this position applicants may submit proposals for other case studies that fit within the overall research project. The case studies may be actor focused or principle based. Possible lines of inquiry include a focus on the Council General Secretariat or an examination of the various systems and rules to maintain confidentiality of information within the domain of executive action in the EU.
Tasks of the postdoctoral researcher:
- Conduct independent research into the normative aspects of accountability with a possible empirical component
- Assist in general leadership of the project
- Assist in supervision of the PhD candidates within the ACELG
- Candidates may also lecture on subjects in the Faculty's curriculum that are related to this project
Tasks of the PhD candidates:
- Engage in supervised scientific research that will ultimately result in a doctoral thesis
- Candidates may also lecture on subjects in the Faculty's curriculum
QUALIFICATIONS:
Qualifications of the postdoctoral researchers:
- A PhD in European law
- (Demonstrated) empirical research skills are an advantage
- Excellent writing skills, fluency in English
Qualifications of the PhD candidates:
- Qualified jurist with excellent knowledge of European law
- (Demonstrated) empirical research skills are an advantage
- Excellent writing skills, fluency in English
CONDITIONS OF EMPLOYMENT:
The appointment will be full-time (38 hours a week). A part-time appointment (32 hours per week) is negotiable. The starting date is 1 October 2010 or shortly thereafter. The appointment will initially be for 1 year. Extension of the contract to a maximum of 2-3 years (postdoctoral researcher) or four years (PhD candidates) is subject to satisfactory performance after the first year.
The gross full-time monthly salary will be in accordance with the salary scales for PhD candidates and postdoctoral researchers at Dutch universities, i.e., ranging from Euro 2,042 in the first year to Euro 2,612 in the final year for PhD candidates, and ranging from Euro 2,379 to Euro 4,374 (salary scales 10-11) for postdoctoral researchers.
